Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Additional agreement:
an agreement whereby the consumer acquires products, digital content and/or services related to a distance contract and these products, digital content and/or services are supplied by SHIFT-Eyewear or by a third party based on an arrangement with SHIFT-Eyewear.

Reflection period:
the period during which the consumer may exercise the right of withdrawal.

Consumer:
the natural person acting for purposes outside their trade, business, craft or profession.

Day:
calendar day.

Durable medium:
any tool, including email, that enables the consumer or SHIFT-Eyewear to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

Right of withdrawal:
the possibility for the consumer to withdraw from the distance contract within the reflection period.

Entrepreneur:
SHIFT-Eyewear V.O.F., operating under the name SHIFT-Eyewear.

Distance contract:
an agreement concluded between SHIFT-Eyewear and the consumer within an organized system for distance selling.

Products:
all products offered by SHIFT-Eyewear, including sunglasses, blue light glasses, clip-ons, glasses cases, cleaning cloths, pouches and other accessories.

Model withdrawal form:
the European standard withdrawal form that consumers may use to exercise the right of withdrawal.

Means of distance communication:
any means that can be used to conclude an agreement without the consumer and entrepreneur being physically present together.

Article 3 – Applicability

These terms and conditions apply to every offer made by SHIFT-Eyewear and to every distance agreement concluded between SHIFT-Eyewear and the consumer.

Before the agreement is concluded, these terms and conditions will be made available via the website or electronically.

If additional terms apply, this will be clearly stated.

In the event of conflicting provisions, the provision most favorable to the consumer shall prevail.

 


 

Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

The offer contains a complete and accurate description of the products offered, including specifications, dimensions, materials, lens type, UV protection, blue light specifications and accessories.

Product images are intended as truthful representations of the products. Minor color differences may occur due to screen settings, photography or production batches.

Obvious mistakes, pricing errors or typographical errors are not binding on SHIFT-Eyewear.

 


 

Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and complies with the applicable conditions.

After receiving the order, SHIFT-Eyewear will send an electronic confirmation.

SHIFT-Eyewear takes appropriate technical and organizational measures to secure electronic data transfer and payment environments.

SHIFT-Eyewear may, within legal limits, assess whether the consumer can fulfill payment obligations.

 


 

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the purchase of a product within 14 days of receiving it without giving any reason.

The reflection period starts on the day after the consumer, or a third party designated by the consumer who is not the carrier, receives the product.

If multiple products are ordered in one order, the reflection period starts on the day the last product is received.

After registering the return, the consumer has another 14 days to send the product back.

The right of withdrawal only applies to consumers.

 


 

Article 7 – Obligations of the Consumer During the Reflection Period

During the reflection period, the consumer must handle the product and packaging with care.

The product may only be inspected and tried on in the same manner as would be possible in a physical store.

The consumer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

 


 

Article 8 – Exercising the Right of Withdrawal and Associated Costs

If the consumer wishes to exercise the right of withdrawal, this must be reported within 14 days of receiving the product by email to eyewear.shift@gmail.com stating the order number.

After the withdrawal notification, the product must be returned within 14 days to the return address provided by SHIFT-Eyewear.

The consumer must return the product with all supplied accessories and, where reasonably possible, in its original condition and packaging.

The direct costs of returning the product are borne by the consumer unless otherwise agreed in writing or in the event of an error by SHIFT-Eyewear.

The risk and burden of proof for the correct and timely return shipment remain with the consumer.

Article 9 – Obligations of SHIFT-Eyewear in Case of Withdrawal

SHIFT-Eyewear will confirm the return request by email as soon as possible.

After receiving and inspecting the returned product, the purchase amount will be refunded within 14 days using the same payment method used for the original transaction.

SHIFT-Eyewear may withhold reimbursement until the returned product has been received and inspected.

Return shipping costs will not be refunded unless legally required.

If the product has diminished in value due to use beyond what is necessary, SHIFT-Eyewear may charge a reasonable reduction in value.

 


 

Article 10 – Exclusion of the Right of Withdrawal

SHIFT-Eyewear may exclude certain products from the right of withdrawal where clearly stated in advance.

This may include:

  • personalized products;

  • engraved products;

  • custom-made products;

  • sealed products that cannot be returned for hygiene reasons once unsealed;

  • digital products where delivery has started with the consumer’s consent.

 


 

Article 11 – Prices

All prices are stated in euros and include VAT unless otherwise indicated.

Any shipping costs will be clearly displayed before completing the order.

SHIFT-Eyewear is not bound by obvious pricing errors.

 


 

Article 12 – Performance of the Agreement and Legal Warranty

SHIFT-Eyewear guarantees that the products comply with the agreement and meet reasonable standards of quality and usability.

All products are covered by the statutory legal warranty.

Damage caused by improper use, dropping, impact, normal wear and tear or careless handling is not covered by the warranty.

If a product is defective or damaged upon delivery, the consumer must contact SHIFT-Eyewear as soon as possible via eyewear.shift@gmail.com including clear photos of the issue.

 


 

Article 13 – Delivery and Execution

SHIFT-Eyewear processes orders with the greatest possible care.

The place of delivery is the address provided by the consumer during checkout.

Orders are fulfilled within the indicated or agreed delivery period.

Delivery times are estimates and do not entitle the consumer to compensation.

In the event of delays, the consumer will be informed accordingly.

The risk of damage or loss remains with SHIFT-Eyewear until delivery to the consumer or a designated third party.

Article 14 – Pre-sale, Pre-orders and Drops

SHIFT-Eyewear may work with pre-sales, pre-orders, limited drops and temporary collections.

Products purchased through pre-sale or pre-order will be delivered later than regular stock items.

Estimated shipping periods are stated as clearly as possible but remain indicative.

Delays due to production, transport, suppliers, customs or logistics may occur.

 


 

Article 15 – Payment

Payment must be made using the payment methods offered during checkout.

The consumer must immediately report inaccuracies in payment details.

If payment is not made on time, SHIFT-Eyewear may suspend or cancel the order.

 


 

Article 16 – Complaints Procedure

Complaints must be submitted within a reasonable time after discovering the issue via:

The complaint should include the order number and a clear description of the issue.

SHIFT-Eyewear will respond within 14 days after receiving the complaint.

 


 

Article 17 – Disputes

All agreements between SHIFT-Eyewear and the consumer are exclusively governed by Dutch law.

Disputes should preferably first be resolved amicably.

If no solution is reached, the dispute shall be submitted to the competent court in the Netherlands.

 


 

Article 18 – Additional or Deviating Provisions

Additional or deviating provisions may not disadvantage the consumer.

Such provisions shall be recorded in writing or electronically on a durable medium.

 


 

Article 19 – Amendments to These Terms and Conditions

SHIFT-Eyewear may amend these terms and conditions.

Changes will be published appropriately.

For ongoing agreements, the version applicable at the time of purchase remains valid unless a newer provision is more favorable to the consumer.
